WWE Suffers Another Trademark Setback Over Randy Orton’s RKO

WWE has encountered another setback in its efforts to trademark Randy Orton’s iconic RKO finishing move for wrestling-related entertainment services.

The United States Patent and Trademark Office (USPTO) issued another refusal of WWE’s application on November 3, citing potential confusion with existing trademarks owned by RKO Pictures, the classic Hollywood movie studio.

The latest decision marks another hurdle for WWE as it attempts to secure broader trademark protection for the three-letter name associated with Orton’s signature move. However, the refusal is nonfinal, leaving the company another opportunity to respond.

USPTO Issues Another Refusal for WWE’s RKO Trademark Application

According to the examining attorney, via Wrestling News Co, WWE’s proposed trademark shares the same dominant wording as six existing registrations held by RKO Pictures. The office specifically noted that one of the studio’s registered marks uses the identical letters “RKO” in standard characters.

The USPTO also determined that WWE’s proposed wrestling services are closely related to RKO Pictures’ entertainment offerings, including film and television production and multimedia services. The examining attorney further requested clarification on whether RKO has any particular significance within the professional wrestling industry or qualifies as a term of art.

WWE originally submitted its application on July 6, seeking trademark protection for wrestling exhibitions and performances broadcast through television, radio and online platforms. The filing also covers providing wrestling news and information online.

This is not the first time WWE has faced resistance over the trademark. Its previous application covering wrestling performances encountered the same conflict with RKO Pictures. The company, however, already holds active RKO trademarks covering merchandise, meaning the latest dispute concerns broader protection for wrestling-related entertainment services.

WWE now has until February 3, 2027, to respond to the USPTO’s nonfinal refusal with arguments and supporting evidence. The company can also request a three-month extension by paying the applicable fee.
